- By hiring/purchasing/using our equipment, you fully agree to all the Terms and Conditions outlined below.
Please read these terms and conditions carefully before placing any orders
If we make a modification, change and/or alteration to these terms and conditions, this will mean you agree to these new terms and conditions.
- ‘Owner’ means Silent Disco Hire Warehouse and its substitutes, successors and permitted assigns and its licensees, franchisees and/or agents;
- ‘Hiring,’ ‘purchasing,’ or ‘using’ refers to the acquisition, ownership, or operation of equipment from Silent Disco Hire Warehouse, with the user assuming full responsibility for the equipment's proper use, care, and any associated risks or consequences as outlined in these terms and conditions.
- **Hirer**, **Purchaser**, **User**, or **You**: Refers to any individual or entity who hires, purchases, or uses the equipment provided by Silent Disco Hire Warehouse. This includes, but is not limited to, individuals, companies, organizations, or groups utilizing the equipment for personal or commercial purposes.
Use of the equipment is at your own risk.
Hiring/Purchasing Conditions
By hiring/purchasing/using equipment from Silent Disco Hire Warehouse, you agree to the following terms and conditions outlined in this document. Silent Disco Hire Warehouse will provide you with the equipment you have requested, in working order, on the date(s) you have booked.
Please make sure that you have thoroughly looked over and checked your equipment. When you receive the equipment, you will be responsible for it once it has been received, and until it is returned. All equipment provided, including but not limited to, headphones, transmitters, storage containers, cables, power boards, lighting, smoke and bubble machines and other equipment needs to be stored securely and returned in the same condition as they were when you received them.
Silent Disco Hire Warehouse ensures all equipment is checked, charged, cleaned and counted before it is provided to you. Should any equipment not be packed or working upon delivery, please contact Silent Disco Hire Warehouse immediately so that we can assist you. Silent Disco Hire Warehouse reserves the right to not issue a refund if nothing is reported once we, the owner, have provided you the equipment and it is out of our possession.
Driver's License or valid ID (such as a passport, or other government issued ID) will be requested upon delivery or pick-up of your equipment if you have not already uploaded this documentation via our scheduling software. Please ensure you bring it with you (We comply with the Privacy Act of 1988).
Delivery or Pick-up of Equipment
Silent Disco Hire Warehouse can offer you the option to pick-up equipment from our business location, or we can deliver the equipment to you for an additional cost; this cost will be included in your invoice.
(unless prior arrangements have been made). Silent Disco Hire Warehouse will provide their best efforts to have all equipment that is hired from us, to be ready for collection at our business, or delivered to you, on the date that has been arranged. Under these terms and conditions Silent Disco Hire Warehouse is not liable for any failure to deliver or delay in delivery for any reason outside of our control.
Returning Equipment
All the equipment should be checked and packed back into the storage containers which will be provided for you. Equipment hired needs to be returned at the agreed upon time and location, and unless specified during booking, is 24 hours after delivery or pick-up at the same location as the delivery or pick-up was made. Equipment that is not returned on time will incur an additional fee which will be decided by Silent Disco Hire Warehouse and will be billed each day until the equipment is returned, unless prior arrangements have been made. Equipment may be returned earlier than 24 hours after delivery or pick-up was made; please notify us if you would like your equipment picked up/dropped off before this time.
Liability
Silent Disco Hire Warehouse is not responsible for any damages, injuries or any negative consequences that may occur with the use of our equipment once it is in the possession of the hirer/purchaser/user (you). The hirer/purchaser/user agrees that the use of the equipment carries with it dangers and risks of injury and the hirer/purchaser/user agrees to accept all dangers and risks associated with this equipment.
In no case shall Silent Disco Hire Warehouse, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Indemnity
To the full extent permitted by law the hirer/purchaser/user (you) releases, discharges, indemnifies and hold harmless Silent Disco Hire Warehouse and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Damage or Loss of Equipment
If any headphones, transmitters, cables, power boards, lights, smoke/bubble machines, storage containers and/or other equipment are lost or damaged, you will be liable for the replacement cost. The cost of replacement will be: $100.00 per headphone and $150.00 per transmitter which will need to be paid upon collection of the equipment. Costs may also be charged for damaged or missing equipment such as, but not limited to, party lights ($100 per light), smoke/bubble machine ($150 per machine), cords/cables ($10 per cord/cable), power boards ($10 per power board), and/or storage containers ($40 per storage container). Silent Disco Hire Warehouse has the right to charge you these damage costs directly to your chosen debit or credit card, and will need to be paid upon, or before collection of the equipment, or as specified by Silent Disco Hire Warehouse.
Orders
We will try to fulfill all our orders, however, if we are unable to fulfill your order due to any reason, we will refund you in whole, or offer an alternative option.
Repossession
Silent Disco Warehouse has the right to retake possession of the equipment if you breach any provision of this agreement.
Costs
We will require a full payment to confirm the booking you have made. Your booking may be cancelled if payment has not arrived by the established pick-up or delivery time.
Cancellation Policy
Once you have booked your equipment and paid for it, any changes or variations may be made up to SEVEN (7) days before your booking time, provided we are able to fulfill this change or variation. Cancelling within 72 HOURS of your booking time will incur a 50% termination fee. Cancelling within 48 HOURS of your booking time will incur a 100% termination fee. If a deposit is made it is non-refundable. If you decide to cancel your booking, Silent Disco Hire Warehouse may retain your payment. This payment can be used for future events if we have the capacity to do so.
Privacy Act
Silent Disco Hire Warehouse only collects and keeps information that you provide that is essential in completing and delivering your order. We follow in accordance with the Privacy Act of 1988 and will never distribute or sell your information.
Disclaimers
The use of the Silent Disco Hire Warehouse and the Silent Disco Hire Warehouse website (www.silentdiscohirewarehouse.com) is at your sole risk. It is your responsibility to ensure that any products, services or information provided through this website meet your specific requirements. Silent Disco Hire Warehouse is not responsible for any injury or damage done with the use of our equipment.

PLEASE BE CAUTIOUS when using the transmitter near a place where pacemakers or any human body ancillary instrument is being used
Most medical device manufacturers recommend keeping a source of potential interference a safe distance away from your medical device.
Consult your doctor and medical device manufacturer for specific guidelines.
If you suspect that this equipment is interfering with your medical device, stop using it and consult your doctor and your medical device manufacturer.
The transmitters can also affect devices that use radio frequency/signal (microwaves, garage doors, wireless fans etc.)
